Emergency Protection Procedures For Children
In certain circumstances where public authorities are concerned about the immediate welfare of children there are certain actions, they can take without requiring an application to the court.
These include:
- Section 20 (sometimes called voluntary accommodation) – this allows the local authority to provide accommodation for your child without the need for any care order.
- Emergency protection order (sometimes called EPO’s) – this gives the local authority parental responsibility of your child.
- Police protection Orders (PPO’s) – this allows police to remove children from their carers without the need for an order
In some circumstances with regards to these applications you may be entitled to Legal Aid funding however assessing your eligibility for this is a tricky job however if you call our offices, we will be able to assist you with this. If you are not eligible for Legal Aid, however, we still can assist you with these kinds of matters.
Grandparents
This can also be obtained by way of a Special Guardianship Order, which importantly would provide you with parental responsibility, allowing for day-to-day decisions as well as more complicated decisions, for example medical choices.
