Care Proceedings

When the Local Authority have serious concerns about the emotional or physical wellbeing of a child, or feel that they are at risk of harm, they can apply to the Court to begin Care Proceedings. This means that they can remove a child from their family, and place them elsewhere, including into foster care.

If the Local Authority have informed you that they are applying for an interim care order or interim supervision order for your children, you will be entitled to legal aid and are then able to instruct your own solicitor. It is important that you seek legal advice in these circumstances so you can be involved in the process effectively and help being involved in deciding what is best for your child.

What happens?

The local authority makes an application to the court and following this the court will arrange an initial hearing. Following this there will be multiple hearing which may include assessments, plans and recommendations.

When the proceedings are near to the end the court will consider what order to make for the child which will be in their best interests. There are a variety of order that the Court can invoke:

  • Care order – this places your child under the care of the local authority
  • Interim care order – this temporarily places your child under the care of the local authority
  • Supervision order – this imposes a duty on the local authority to assist you in caring for your child
